User Service Agreement
Introduction
Welcome to the VR panoramic online production and related services provided by 5itui (hereinafter referred to as "this platform" or "us"). This platform is an online VR panoramic content creation and management tool, offering users functions such as panoramic image uploading, panoramic scene editing, hotspot interaction settings, and VR work publishing and display.
Before using the services of this platform, please be sure to carefully read and fully understand the terms and conditions of this agreement, especially the important terms marked in bold or underlined. Any act of registering, logging in, or using the services of this platform is deemed to be your full understanding and acceptance of all the contents of this agreement.
- Service Content and Description
1.1 This platform provides users with VR panoramic online production services, including but not limited to: uploading and processing of panoramic images and videos, creation and editing of panoramic scenes, setting of hotspots and interactive functions, online preview and publishing of VR works, sharing and embedding of work links, and other functions. The specific service content is subject to the actual provision of the platform.
1.2 You understand and agree that some functions of this platform may rely on third-party services (such as cloud storage, content delivery network, AI intelligent generation, etc.), and we do not guarantee the availability, stability, and accuracy of third-party services.
1.3 This platform reserves the right to adjust, upgrade, suspend, or terminate the service content based on its own operational strategies or legal and regulatory requirements, and will endeavor to notify you in advance through platform announcements or other means.
II. User Registration and Account Security
2.1 When registering, you should provide true, accurate, and complete personal information, and update it promptly when there are changes. You shall bear any consequences arising from inaccurate or incomplete information.
2.2 Your account (including username, password, bound mobile number, email, etc.) serves as your sole identity on this platform, and you should keep your account information and password secure. Any actions conducted through your account are deemed as your own actions, and you shall bear the corresponding legal responsibilities.
2.3 If you discover that your account has been misused or there is a security vulnerability, please notify us immediately. Our platform will not be responsible for any losses incurred due to account or password leakage caused by your own reasons.
III. User Content and Intellectual Property
3.1 The intellectual property rights of the VR panoramic works (including but not limited to panoramic images, videos, audios, text descriptions, interactive settings, etc., hereinafter collectively referred to as "user content") you upload, create, and publish through this platform still belong to you or your legally authorized party.
3.2 You grant this platform the right to store, process, display, and transmit your user content to the extent necessary for providing services. This authorization is solely for the purpose of providing you with platform services, and we will not use your user content for any other commercial purposes.
3.3 You guarantee that you possess legal rights or have obtained necessary authorization for all content uploaded to this platform, and that such content does not infringe upon any third party's intellectual property rights, portrait rights, privacy rights, reputation rights, or other legitimate rights and interests.
3.4 You understand and agree that the public works you post on the platform may be browsed and shared by other users. For the content you choose to publicly post, you should assess the risks that may arise from it yourself.
3.5 The intellectual property rights of this platform (including but not limited to the platform name, logo, interface design, technical architecture, software code, etc.) belong to the operator of this platform. Without explicit written permission, you are not allowed to copy, modify, reverse engineer, or use the aforementioned content in any other manner.
IV. User Behavior Guidelines
4.1 When using the services of this platform, you shall strictly abide by the laws and regulations of the People's Republic of China and shall not use this platform to engage in any illegal or irregular activities.
4.2 You shall not use this platform to create, upload, publish, or disseminate the following content:
(1) Opposing the basic principles established by the Constitution, endangering national security, leaking state secrets, subverting state power, and undermining national unity;
(2) Damaging national honor and interests, and harming public interests;
(3) Inciting ethnic hatred, ethnic discrimination, and undermining ethnic unity;
(4) Undermining national religious policies, promoting cults and feudal superstitions;
(5) Spreading rumors, disrupting social order, and undermining social stability;
(6) Content containing obscenity, pornography, gambling, violence, homicide, terror, or abetting criminal activities;
(7) Insulting or defaming others, infringing upon others' legitimate rights and interests such as reputation, privacy, portrait rights, intellectual property rights, etc;
(8) Containing false, fraudulent, or misleading information;
(9) Content that contains other prohibited content as stipulated by laws and regulations.
4.3 You shall not use this platform to engage in the following behaviors:
(1) Conduct reverse engineering, reverse assembly, reverse compilation, or otherwise attempt to obtain the source code of the platform;
(2) Using any automated tools (such as crawlers, scripts) to collect platform data or other user content in bulk;
(3) Interfering with, disrupting, or restricting the normal operation of the platform, including but not limited to spreading viruses, Trojans, malicious codes, etc;
(4) Engaging in illegal activities or seeking improper benefits by exploiting platform vulnerabilities;
(5) Resell, lease, or provide the services of this platform to a third party for use without permission.
4.4 If you violate the above regulations, this platform has the right to take measures such as warning, restricting functions, suspending services, deleting content, permanently banning accounts, etc., and reserves the right to pursue legal liability.
V. Fees and Payment
5.1 Some functions of this platform are provided free of charge for a short-term trial period. Subsequent functions or value-added services may require payment for use. The specific charging standards and billing methods shall be subject to the public announcement on the platform page.
5.2 When you recharge or purchase services through the payment methods supported by this platform, you are deemed to agree to pay the corresponding fees according to the published charging standards.
5.3 Except where otherwise provided by laws and regulations or specifically stated by the platform, the recharge amount already consumed and the purchased package services are non-refundable.
VI. Disclaimer and Limitation of Liability
6.1 You understand and agree that the services provided by this platform are based on the "current status" and "availability", and we do not make any express or implied guarantees regarding the timeliness, accuracy, reliability, or completeness of the services.
6.2 In the event of service interruptions or data loss due to force majeure (including but not limited to natural disasters, wars, policy changes, cyber attacks, power outages, third-party service failures, etc.), this platform shall not be held liable, but we will make reasonable efforts to minimize the impact on you.
6.3 When using the services of this platform, you should backup important data on your own. This platform shall not be liable for any data loss caused by your operational errors, account loss, password leakage, or other reasons.
6.4 To the maximum extent permitted by applicable laws, the total liability of this platform to you shall be limited to the total amount of fees actually paid by you within the twelve months prior to the loss you suffered on this platform.
VII. Alteration and Termination of the Agreement
7.1 This platform reserves the right to amend this agreement as needed. The amended agreement shall take effect immediately upon publication. If you do not agree to the amended agreement, you should immediately stop using the services of this platform.
7.2 You can log out of your account in the account settings. After logging out, we will handle your personal information and user content in accordance with the law.
VIII. Applicable Law and Dispute Resolution
8.1 The formation, performance, interpretation, and dispute resolution of this agreement shall be governed by the laws of the mainland region of the People's Republic of China.
8.2 Any dispute arising from this agreement shall be resolved through friendly negotiation between the parties. If the negotiation fails, either party shall have the right to bring a lawsuit to the people's court with jurisdiction over the place where the operator of this platform resides.
